"Printing Industry Management Ordinance" (on)

Chapter I General Provisions Article 1 These Regulations are formulated for the purpose of strengthening the management of the printing industry, safeguarding the lawful rights and interests of the printing industry operators, providing public interests, and promoting the building of socialist spiritual civilization and material civilization.
Article 2 This Regulation applies to the printing and operating activities of publications, packaging and decoration printed matter and other printed matters.
The publications referred to in these Regulations include newspapers, periodicals, books, maps, New Year pictures, pictures, calendars, albums, audio and video products, and the covers of electronic publications.
The packaging and decoration prints referred to in these Regulations include trademarks, advertising products, and printed materials such as paper, metal, and plastic that are packaged and decorated as products.
Other publications referred to in these Regulations include documents, materials, charts, tickets, certificates, and business cards.
The printing business activities referred to in these Regulations include the operations of typesetting, plate making, printing, binding, copying, photocopying, and printing.
Article 3 The operators of the printing industry must abide by relevant laws, regulations and rules, and emphasize social benefits.
It is forbidden to print publications, packaging and decorating printed matter, and other printed materials that contain reactionary, obscene, superstitious content, and other contents that the country has explicitly prohibited from printing.
Article 4 The State Council’s publishing administrative department shall be responsible for the supervision and administration of the printing industry throughout the country. The administrative department responsible for publication management (hereinafter referred to as the publishing administrative department) of the local people's government at or above the county level shall be responsible for the supervision and administration of the printing industry within its administrative area.
The public security departments, industrial and commercial administrative departments and other relevant departments of the people's governments at or above the county level shall be responsible for the supervision and administration of the relevant printing industries within their respective scope of duties.
Article 5 The operators of the printing industry shall establish and improve the system for the verification of printing, the system for registering printing, the system for storing printed materials, the system for the delivery of printed materials, and the system for destroying defective products in printing activities. The specific measures shall be formulated by the State Council's publishing administrative department and the public security department of the State Council.
The operator of a printing industry who finds any illegal or criminal activity in the printing business activities shall report to the public security department or the publishing administrative department in a timely manner.
Article 6 Social organizations in the printing industry implement self-discipline management under the guidance of the publishing administrative department in accordance with their statutes.
Chapter II Establishment of Printing Enterprises Article 7 The State adopts a licensing system for printing operations. Any entity or individual that does not obtain a printing business license in accordance with the provisions of these Regulations shall not engage in printing business activities.
Article 8 The establishment of a printing enterprise shall meet the following conditions:
(-) The name and the constitution of the company;
(b) have a defined scope of business;
(3) Production and business establishments and necessary capital, equipment and other production and business conditions that meet the needs of the business scope;
(4) Organizations and personnel that meet the needs of the business scope;
(5) Other conditions stipulated by relevant laws and administrative regulations.
The approval of the establishment of a printing company shall, in addition to the provisions of the preceding paragraph, also comply with the State's plans for the total number, structure and layout of printing enterprises.
Article 9 An enterprise established to engage in the printing and printing of publications, packaging, decoration, and other printed matters shall submit an application to the administrative department of publishing of the people's government of the province, autonomous region or municipality directly under the Central Government where the enterprise is established; The administrative department of publishing of the people's government of the class applies. If the applicant has been approved by the auditor, he will obtain a printing business license; he will apply for a printing business license in accordance with the relevant state regulations and apply to the public security department. After obtaining approval for a special industry, he will hold a printing business license and a special industry license. The administrative department for industry and commerce applied for registration and obtained a business license.
Individuals may not engage in the printing and printing business of publications and packaging and decoration; if they are engaged in other printed matters, they shall go through the examination and approval procedures according to the provisions of the preceding paragraph.
Article 10: The publishing administrative department that accepts applications for establishment of enterprises engaged in printing business activities shall, within 60 days from the date of receipt of the application, make a decision of approval or disapproval. Where an application for establishment is approved, a printing operation permit shall be issued; if an application for establishment is not approved, the applicant shall be notified and the reasons shall be explained.
The printing business license shall indicate the type of printing business activities that the printing company is engaged in.
Printing licenses may not be sold, rented, loaned, or transferred in other forms.
Article 11 Business operators of the printing industry who apply concurrently or change their business operations in the printing of publications, packaging and decoration prints or other printed matter, or merge other printing industry operators, or establish new printing industry operators due to mergers and divisions, shall In accordance with the provisions of Article 9 of the present Regulations, go through the formalities.
The operator of the printing industry shall change the name, legal representative or responsible person, residence or business premises, etc., or terminate the printing business activities. It shall go through the registration and cancellation of the registration with the public security department and the administrative department for industry and commerce that originally registered. The publishing administrative department that was originally approved for the establishment shall be put on record. Article 12 The State permits the establishment of Sino-foreign joint venture printing enterprises and Sino-foreign cooperative printing enterprises, and allows the establishment of foreign-funded enterprises engaged in the printing of packing and decorating printed matter. The specific measures shall be formulated by the State Council's publishing administrative department in conjunction with the State Council's foreign economic and trade authorities.
Article 13 In order to establish a printing factory (institution) within a unit, it must go through the registration formalities with the publishing administrative department of the local people's government at or above the county level, and file a report with the public security department in accordance with relevant state regulations; printing at the printing plant (institution) established within the unit involves If the state secrets are printed, it shall also go through the registration formalities with the confidentiality department.
The printing factories (institutions) established within the units shall not engage in printing business activities; in the case of printing business activities, they must go through the formalities in accordance with the provisions of this chapter.
Chapter III Printing of Publications Article 14 The State encourages enterprises engaged in publications printing and printing activities to promptly print publications that reflect new and outstanding cultural achievements at home and abroad. Emphasis on the printing of traditional cultural products and valuable academic works.
Article 15 An enterprise that engages in publications printing and printing activities shall not print publications that the country explicitly prohibits publication and publications that are not published by the publisher.
Article 16 In the case of printed publications, the entrusted printing unit and the printing enterprise shall sign a printing contract in accordance with the relevant provisions of the State.
Article 17 If a printing company accepts printing units to entrust the printing of books or periodicals, it must verify and store the printing power of attorney stamped by the publishing unit, and before printing, report to the publishing administrative department of the people's government of the province, autonomous region or municipality directly under the central government where the publishing unit is located; Where a printing company accepts the entrustment of printing books or periodicals by a publishing unit outside the province, autonomous region, or municipality directly under the Central Government, the printing power of attorney must also report in advance to the publishing administrative department of the people's government of the province, autonomous region, or municipality directly under the Central Government where the printing enterprise is located. The power of attorney is prescribed by the publication administrative department of the State Council in a uniform format, which is printed uniformly by the publishing administrative department of the people's government of the province, autonomous region, and municipality directly under the Central Government.
If a printing company accepts the printing unit's entrustment to print newspapers, it must verify the newspaper's publishing license; if it accepts printing units' entrusted printing of newspapers or periodical editions or supplements, it must also verify that the competent publishing administration approves the publication of additional editions and supplements.
